Terms of Service

Effective date: June 1, 2026

1. Acceptance of terms

By accessing or using WERC ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time; continued use of the Service after changes constitutes your acceptance. The current effective date is always shown at the top of this page.

2. Account responsibilities

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the confidentiality of your password and for all activity under your account.
  • You must notify us immediately at legal@werc.app if you suspect unauthorised access to your account.
  • You may not share your account credentials with others or create accounts on behalf of third parties without their consent.
  • One person or entity may not maintain more than one free account.

3. Pro subscription

WERC Pro is a paid subscription tier that unlocks additional features.

  • Free trial: New Pro subscribers receive a 7-day free trial. Your payment method will be charged at the end of the trial period unless you cancel before it ends.
  • Billing: Pro is billed monthly at $9 / month (subject to change with 30 days' notice). All fees are in USD and exclusive of applicable taxes.
  • Cancellation: You may cancel your Pro subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain Pro access until then.
  • Refunds: Subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact legal@werc.app within 14 days of the charge.
  • Price changes: We will give at least 30 days' notice of any price increase via email before it takes effect on your subscription.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated tools (bots, scrapers) to access or interact with the Service at scale without our written consent.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Post content on the public focus feed that is abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.

5. User content

You retain ownership of any content you submit to the Service (session labels, notes, profile information). By submitting content you grant WERC a worldwide, non-exclusive, royalty-free licence to store, display, and distribute that content solely as necessary to provide the Service. You represent that you have the right to submit any content you provide and that it does not infringe any third-party rights.

6. Intellectual property

The Service, including its design, code, binaural audio assets, and branding, is owned by WERC and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you a right to use our trademarks, logos, or trade names without our prior written consent.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. USE OF THE SERVICE IS AT YOUR OWN RISK.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WERC AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) $10 USD.

9. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall first be attempted to be resolved by good-faith negotiation. Contact us at legal@werc.app to initiate a resolution.
